Constitutional Law for a Changing America: Institutional Powers and Constraints, 8th Edition Lee Epstein, University of Southern California, School of Law Thomas G. Walker, Emory University
Drawing on both political science and legal studies, Constitutional Law for a Changing America: Institutional Powers and Constraints, Eighth Edition helps students realize that Supreme Court cases are more than just legal names and citations. From lawyers and interest groups, to the shifting sentiments of public opinion, to the ideological and behavioral inclinations of the justices, Epstein and Walker show how all these dynamics play an integral part in the overall development of constitutional doctrine. As always, Epstein and Walker account for the most recent Supreme Court cases and the latest scholarship on the justices and their decisions. With meticulous updating throughout, the authors include reworked and revised discussion on: - the methods of constitutional interpretation,
- jurisdiction stripping and standing,
- theories of presidential power,
- the separation-of-powers doctrine,
- cases related to the war on terrorism,
- federal preemption of state laws, and
- new developments in the interpretation of the commerce, taxing, and spending powers.
In preparing this edition, Epstein and Walker reorganized chapters, sharpened the editing of case excerpts, and added supplementary material—all with the goal of enhancing student understanding of constitutional law and the judicial process. Key Features: - Significantly reorganized material in Chapter 6 (Federalism) and Chapter 7 (The Commerce Power) improves the narrative flow and enhances student understanding.
- Expanded treatment of federal taxing and spending powers provides students with critical, up-to-date information.
- Increased coverage of the debates over the constitutionality of health care and immigration polices featuring case excerpts from National Federation of Independent Businesses v. Sebelius (2012) and Arizona v. United States (2012).
- Enhanced online resources include the latest cases, making the development of constitutional doctrine relevant to today’s most important political conflicts.
- New "Aftermath" boxes—students’ favorite feature—round out chapter coverage.
- A balance of case law and textual elaboration puts cases in context and helps students realize their relevance for difficult issues facing political actors and judicial decision makers in our constitutional democracy today.
- “Facts” and “Arguments” sections in the case commentary details the facts of the case and the attorneys’ arguments for each side to facilitate close reading of opinions.
- New Annotated Readings section points students to relvant and important works for further reasearch.
- A focus on themes such as power, capacity, and democratic accountability helps students understand why state and federal government officials have the authority to do the things that they do.
- Expertly edited Supreme Court cases preserve crucial elements, while facilitating the development of students’ critical analysis skills.
